The EU AI Act became law in May 2024. Most of the world’s tech press covered it as a future problem. In April 2026, four months away from the August 2026 enforcement deadline, it’s become an immediate problem for thousands of companies.
Here’s why the timing matters. The EU AI Act has a staged enforcement schedule. The highest-risk AI systems (hiring tools, credit scoring, biometric identification) aren’t covered by a gradual rollout. They go live in August 2026. That’s not a gentle transition. That’s a cliff.
If you’re a mid-market SaaS company, a recruitment firm, a financial services player, or a healthcare provider using AI, this applies to you. If you’re a US-based company with even one employee in the EU, this applies to you. The extraterritorial reach is real. The EU learned from GDPR enforcement, and they’re not soft on boundary cases.
The EU AI Act isn’t a blanket ban on AI. It’s a tiered regulation system. Think of it like food safety rules: not all restaurants have the same requirements. A fast-food franchise has simpler rules than a hospital cafeteria. AI works the same way.
The act creates four risk categories. Prohibited-risk systems are outright banned (social credit scoring, real-time biometric mass surveillance in public spaces). Limited-risk systems have transparency requirements but aren’t heavily restricted. High-risk systems require extensive documentation, human oversight, and testing. Minimal-risk systems have almost no requirements.
The gap between minimal-risk and high-risk compliance is vast. A minimal-risk system might require you to disclose you’re using AI. A high-risk system requires you to maintain detailed logs of how the AI reaches every decision, retrain the model regularly, conduct regular bias audits, and prove you have a qualified human reviewing decisions.
Most businesses get confused here because they assume their use case is lower-risk than it actually is. A company using AI to review resumes thinks they’re in the lower tier. They’re not. They’re high-risk, and they’ve got four months to prove it.

The second tier (high-risk system failures) goes up to €15 million or 3% of turnover. The third tier (providing false information) goes up to €10 million or 2% of turnover. The fourth tier (technical compliance failures) is up to €5 million or 1% of turnover.
These aren’t theoretical fines. The EU has a track record of aggressive GDPR enforcement. They’ve issued billion-dollar fines to tech companies for data privacy violations. The AI Act enforcement will follow the same pattern. The EU explicitly wants to signal that this regulation is serious.
Realistically, first violations might be lower if you can demonstrate good faith compliance efforts. But if you’re caught using high-risk AI with zero documentation, zero bias testing, and zero human oversight in August 2026 when the deadline has passed? The EU’s legal framework allows them to start with the maximum penalty and negotiate down.

Month one (April-May): Audit and classify. Create a comprehensive list of every AI system your company uses. Include customer-facing AI, internal tools, vendor AI systems, everything. For each system, classify it according to the EU AI Act risk categories. Which ones are high-risk? Start there. You’ll likely find your hiring tools, credit assessment tools, and customer-facing decision systems are all high-risk. Your data analysis tools and marketing recommendation engines are probably lower-risk. Document your reasoning for each classification. This documentation becomes part of your compliance file.
Month two (May-June): Vendor assessment and documentation. For each high-risk system, determine whether you built it or a vendor did. For vendor systems, reach out and ask about EU AI Act compliance. Request their compliance documentation, testing results, and bias audit reports. For systems you built in-house, start gathering documentation. How does the system work? What data does it use? How does it handle edge cases? What testing have you done? Document this thoroughly.
Month three (June-July): Testing and remediation. High-risk systems need bias testing across protected categories. This doesn’t require hiring a ML researcher. Tools like Fairlearn (open source), Fiddler AI, and Truera provide bias audit reports. Run your models through these tools. Where you find bias, document it and your remediation plan. You don’t need to achieve zero bias (impossible), but you need to demonstrate you’ve tested systematically and addressed known issues.
Month four (July-August): Policies and training. Build the policies and processes that wrap around your AI systems. Who reviews decisions? How often? How do you handle appeals? How do you respond to data subject access requests about AI decisions? Document this as your operational policy. Train your team on these policies. This documentation is what the EU auditors will review.
Not every AI system requires the same level of compliance. The EU AI Act deliberately carved out lower-risk categories to avoid over-regulation.
Minimal-risk AI systems only require transparency. Your AI recommendation engine recommending products? Minimal-risk. Your marketing chatbot? Minimal-risk. Your predictive analytics dashboard for internal business insights? Probably minimal-risk. For these, the requirement is simple: tell users they’re interacting with AI.
Limited-risk systems (things like biometric emotion recognition or certain surveillance tools) require some technical documentation but not the full high-risk burden. Your internal performance analytics tool using AI? Limited-risk, probably.
The regulation is actually thoughtful about not crushing innovation in low-stakes use cases. The bite is specifically aimed at high-risk decisions affecting people’s rights and opportunities. That’s appropriate. That’s also where you should be focusing your four months.
Yes, if you have EU customers or EU-based employees, the act applies to you. The EU AI Act has extraterritorial reach similar to GDPR. Any organisation placing AI systems on the EU market or affecting people in the EU must comply, regardless of where the organisation is headquartered.

Start by asking them directly. Reputable vendors will have a compliance statement, a roadmap, or will be listed in the EU AI Office’s upcoming database of high-risk AI systems. If a vendor can’t answer basic questions about their EU AI Act compliance plans by mid-2026, that’s a red flag worth taking seriously.
